Patrick Byrne’s position against naked shorting might have been somewhat vindicated given the recent newsflow, although I still do not see anyone giving him props on the internets.
It is a complicated issue, but from what I can see today Hedgistan has taken back the ball after regulators fumbled at the goalline, and this game is far from over.
He took his case straight to the people last week; funny that his stock (OSTK-NASDAQ) ramped as he went off the Regulation SHO threshold list, and is now falling as shorts are re-established and the stock goes back on. Of course, the recent earnings release probably had something to do with the recent swoon.
